Description

“The Firm Retreat: Part 2” is the second 1-hour part in a 3-part CLE Ethics Program offered free for Virginia attorneys in partnership with the Virginia State Bar. 

Each 1-hour part will show a short video taking us behind the scenes as a law firm holds its annual staff retreat.  A panel of your peers will apply the Virginia Rules of Professional Conduct to their analysis of the issues presented. During the panel discussions, attendees will be encouraged to ask questions and share comments. 

Ultimately, the goal is for you to leave the program with a greater sensitivity of the many ethical issues that can be in play any day of the week, be better prepared to view these issues as learning opportunities and be more willing to take advantage of these opportunities in order to see that the issues are responsibly addressed and resolved.

In Vignette Two “Down to Business,” the panel will discuss the issues raised when a client dies during settlement negotiations, concerns surrounding the use of crowdfunding, use of the term “minimum fees” in an engagement agreement, and the responsibilities that arise when deploying generative AI in the practice of law.

Since 1998, Mark Bassingthwaighte, Esq., has been a Risk Manager with ALPS, the nation’s largest direct writer of lawyers’ malpractice insurance. In his tenure with our company, Mr. Bassingthwaighte has conducted over 1200 law firm risk management assessment visits, presented over 600 continuing legal education seminars throughout the United States, and written extensively on risk management, ethics, and technology. Mr. Bassingthwaighte is a member of the State Bar of Montana as well as the American Bar Association where he currently sits on the ABA Center for Professional Responsibility’s Conference Planning Committee. He received his J.D. from Drake University Law School.

Seth M. Guggenheim


Seth Guggenheim joined Shumack & Guggenheim, PLLC in January 2023 following a robust career in private and government practice. He is AV Rated by Martindale-Hubbell.

Seth has taught Ethics for Trial Lawyers for nine years as an adjunct professor at American University's Washington College of Law. He also regularly presents ethics-focused continuing legal education programs to bar audiences in Virginia.

From 2012-2021, Seth served as Assistant Ethics Counsel to the Virginia State Bar. In this role, he provided confidential advice through the Bar's Ethics Hotline, assisted the Bar's Standing Committee on Legal Ethics in formulating proposed opinions, and made presentations at the Annual Disciplinary Conference of the Virginia State Bar.

From 2000-2012, Seth served as Assistant Bar Counsel and then Senior Bar Counsel (2007-2012) in Virginia, roles in which he was responsible for investigating and prosecuting bar complaints before District Committees, the Virginia State Bar Disciplinary Board, and three-judge Circuit Courts. At the Bar's request, Seth argued two disciplinary cases before the Supreme Court of Virginia.

Krista M. Mathis Samuels serves as Assistant Ethics Counsel at the Virginia State Bar. Prior to joining the VSB, Krista was in private practice, first with a small Richmond firm immediately after law school, and then for nearly 14 years at her own solo practice where she focused on juvenile and mental health law. She left private practice in 2020 to work with the Virginia Office of the Attorney General representing agencies within the Virginia Department of Health and Department of Behavioral Health and Developmental Services and joined the VSB in October 2022. Krista graduated from the University of Virginia with majors in psychology and government in 2000 and received her JD from the University of Richmond in 2003.
