Description

This program will start with a discussion on the importance of documenting scope of representation on all new matters to include detailing the specifics of what should be included in a well written engagement letter. The program will then shift to a discussion on how billing practices can help avoid collection problems that will include practical tips on how to minimize the likelihood of a malpractice claim arising in response to debt collection activities.

Program Materials: While the final set of written materials is not yet fully developed, based upon the current draft, the presenter anticipates that the final materials set will be at least 22-23 pages in length and will include several sample forms. Since 1998, Mark Bassingthwaighte, Esq., has been a Risk Manager with ALPS, the nation’s largest direct writer of lawyers’ malpractice insurance. In his tenure with our company, Mr. Bassingthwaighte has conducted over 1200 law firm risk management assessment visits, presented over 600 continuing legal education seminars throughout the United States, and written extensively on risk management, ethics, and technology. Mr. Bassingthwaighte is a member of the State Bar of Montana as well as the American Bar Association where he currently sits on the ABA Center for Professional Responsibility’s Conference Planning Committee. He received his J.D. from Drake University Law School.
