During this program, two short videos will be played — “The Bar Report” and “The Final Segment” — both of which will raise ethical issues that Mark and Rob will discuss in depth. First up will be “The Bar Report,” which is a brief legal news commentary segment. Issues presented include responsibilities that arise post discovery of fraudulent billing practices by a firm attorney, the meaning and purpose of the phrase “to prevent reasonably certain death or substantial bodily harm” found in Rule 1.6, ethical concerns with chatbots and other AI tools, text message advertising, and the pros and cons of using text messaging as a means of communicating with clients.
In “The Final Segment,” the focus will shift to trying to define the term ‘generally known” in the context of Rule 1.9, and include a discussion on multiple client representation, responding to a malpractice claim, and steps firms should be taking given the rise of ransomware.

Since 1998, Mark Bassingthwaighte, Esq., has been a Risk Manager with ALPS, the nation’s largest direct writer of lawyers’ malpractice insurance. In his tenure with our company, Mr. Bassingthwaighte has conducted over 1200 law firm risk management assessment visits, presented over 600 continuing legal education seminars throughout the United States, and written extensively on risk management, ethics, and technology. Mr. Bassingthwaighte is a member of the State Bar of Montana as well as the American Bar Association where he currently sits on the ABA Center for Professional Responsibility’s Conference Planning Committee. He received his J.D. from Drake University Law School.
Rob has been the Claims Manager with ALPS since 2005 and is responsible for the company's day-to-day claims operation. Since joining ALPS in 1999, Rob’s work experience has included the investigation, evaluation and resolution of complex lawyers’ professional liability claims and supervising the claims department. In addition to working as a claims attorney, he has also worked as Associate Counsel for ALPS parent company, ALPS Corporation. Prior to joining ALPS, Rob practiced law for eight years in Montana and Pennsylvania where the bulk of his experience was in malpractice defense and general litigation. He is a graduate of the University of Montana, 1983, and the University of Montana School of Law, 1991, where he graduated with high honors.
