Program Description:

This program will start with the playing of am 11-minute video vignette entitled “Hot Topics” which will setup a few ethical issues that Mr. Bassingthwaighte and his guest claims attorney will discuss in depth. The issues will be safeguarding property in todays wired world, obligations to prepare for and monitor for cyber breaches, obligations post cyber breach, disaster recovery planning in light of ABA Formal Opinion 482, and the obligations firms might have to foster attorney wellness.

A Sampling of Attendee Takeaways:

  • Identification of the specific obligations attorneys have and the issues they should be thinking about in order to prepare for and respond to a possible cyber breach.
  • Guidance on disaster planning.
  • An understanding of the importance of prioritizing wellness at the office to include the sharing of practical steps firms can take to get help get there.

Program Materials:

Attendees will receive a set of written materials that will be approximately 40 pages in length. These materials will include the text of relevant Rules of Professional Conduct and detailed answers to the ethical questions raised in the video vignette.

Since 1998, Mark Bassingthwaighte, Esq., has been a Risk Manager with ALPS, the nation’s largest direct writer of lawyers’ malpractice insurance. In his tenure with our company, Mr. Bassingthwaighte has conducted over 1200 law firm risk management assessment visits, presented over 600 continuing legal education seminars throughout the United States, and written extensively on risk management, ethics, and technology. Mr. Bassingthwaighte is a member of the State Bar of Montana as well as the American Bar Association where he currently sits on the ABA Center for Professional Responsibility’s Conference Planning Committee. He received his J.D. from Drake University Law School.

Tim Line grew up in Missoula, Montana. He received his juris doctorate degree from the University of Montana School of Law in 1994. He first worked in private practice for 2 years, and then in 1996 he began a career as a law clerk in federal court working for several judges until August 2019. For those 23 years he worked on a wide variety of civil action cases proceeding in federal court. He began working as a Claims Attorney at ALPS in November 2019. Tim grew up on a cattle ranch, and continues operating the same cattle ranch today with his wife, two sons, and extended family members. In his spare time he enjoys outdoor recreational activities in the mountains and trails of Montana.
